When you have to deal with a CIS registration or EVR registration, this has major consequences. What is a CIS registration?

A CIS registration means that your personal data is included in the database of Stichting CIS (Central Information System). This database is accessible to almost all insurers in the Netherlands.
Although some registrations are administrative, others can be very harmful.

Reasons for a CIS registration

You will be included in CIS, among other things, when:

  • there are payment arrears towards the insurer;

  • you have claimed damage that the insurer assesses as irregular;

  • your policy has been terminated due to risky behavior;

  • you have suffered damage without insurance;

  • a suspicion of fraud has been established.

Note: The CIS Foundationdoes not only keep registrations related to fraud. Other situations can also lead to a mention, such as:
  • Damage claims: If you regularly or conspicuously claim damage, this may give rise to a registration.
  • Driving disqualification: If your driving privilege has been disqualified, for example after a serious traffic offence, this may also be noted in the CIS.
  • Confidential Notices: Your insurer may place a Confidential Notice if, for example, you do not pay the premium (even after a reminder) or do not cooperate in a claim investigation.
In addition, there is theExternal Referral Register (EVR), a separate registration within the CIS system, which is mainly used in cases of (suspected) insurance fraud.

Many clients only discover much later that they are registered.


What is an EVR registration?

The External Referral Register (EVR) is part of the Protocol Incident Warning System for Financial Institutions (PIFI).
This includes reports of serious incidents, including insurance fraud.
Consider situations in which an insurer believes that you have deliberately provided incorrect information.

The importance of intent in a EVR registration

Before an insurer may include you in the EVR, an important principle applies: intent. It must appear that you have acted deliberately with the aim of misleading the insurer, for example by providing fraudulent information in order to receive benefits. Just suspecting fraud is not enough. According to the Protocol Incident Warning System for Financial Institutions (PIFI) and case law, the insurer must actually be able to demonstrate that you have acted deliberately. A mistaken identity, misunderstanding or innocent mistake should therefore not lead to aEVR registration. Why is this so important? AEVR registration is drastic, as described above: it significantly limits your options on the financial market. Care and proof are therefore mandatory. If the intent criterion is not established, there are often good legal options to cancel your registration—whether or not through the courts.

An EVR registration is radical because:

  • this is shared with banks, insurers and financial institutions;

  • you often cannot take out new insurance;

  • loans, mortgages and financial products are refused;

  • the registration can remain for 8 years.

An EVR registration is therefore comparable to a fraud report — but not every report is justified. We regularly see that insurers register too quickly.

Can an EVR registration have consequences for housemates or family members?

Yes, an EVR registration can unfortunately extend further than just yourself. Because registration with Stichting CIS is linked to your name and home address, housemates or family members who live at the same address may be indirectly affected by this. In practice, we regularly see that insurers are extra critical of applications from people who are registered at the same address. Sometimes housemates or partners are not accepted for new insurance, simply because of the address. There are even situations in which an insurer sets a condition that you may not be included as a regular driver on a car insurance policy. In short: an EVR registration can unintentionally affect the entire household. This makes it all the more important to assess whether the registration has been placed correctly and, where possible, to take legal action for removal.

When is a CIS or EVR registration created?

Registrations can arise from, among other things:

  • failure to comply with payment agreements;

  • termination of the insurance due to negative claims;

  • Driving damage with an uninsured car;

  • a driving ban;

  • suspected fraud;

  • unclear or incorrect claim handling.

Things often go wrong, especially when fraud is suspected.
Insurers sometimes register too quickly, with insufficient evidence or without weighing up interests — something that is not legally permitted according to the GDPR and the PIFI protocol.


How long does a CIS or EVR registration remain valid?

The retention periods differ per reason:

  • 15 months – negative claim-free years

  • 3 years – unfulfilled financial obligations

  • 5 years – damage with an uninsured car, breach of contract or driving ban

  • 8 years – EVR fraud registration

Note:
These terms are the maximum permitted, but not automatically proportional.
A lawyer can argue that a registration should be removed earlier if the impact is disproportionate.


What are the consequences of a CIS or EVR registration?

A registration can lead to:

  • refusal from almost all regular insurers;

  • significantly higher premiums with special “second chance insurers”;

  • problems with mortgage applications;

  • block when borrowing or credit cards;

  • limitation for business insurance (ZZP / BV);

  • financial exclusion for up to 8 years.

EVR registrations in particular can affect an entire working life — for example in professional groups that require reliability.

Other common issues in insurance law

In addition to CIS and EVR registrations, there are other situations in which insured parties encounter unexpected problems. Consider:
  • Suspension of coverage due to premium arrears: If a premium is not paid (on time), your insurer may decide to temporarily suspend coverage. You will then not be insured during that period—even if you pay later. Many people only notice this when they want to claim damage, but later it turns out that they are not covered.
  • Non-payment after car theft: Is your car stolen, but the insurer refuses to pay out? This happens more often than people think. Causes can range from alleged incomplete information to doubts about the legality of the claim. Every year, The Vehicle Crime Insurance Agency reports thousands of car thefts in the Netherlands, but not every victim receives compensation for their damages.
  • Rejection of claims: Insurers may reject claims due to alleged inaccuracies in the application, or because they believe that the policy conditions have not been met. Sometimes the rejection takes place without clear motivation, or a client is referred to a complaints procedure without really looking at the content.
  • Increase in premium or unilateral change of policy conditions: Some insurers increase the premium significantly after an incident, or change the coverage in the meantime. This can have far-reaching financial consequences, especially for people who are dependent on specific insurance.
Regardless of the problem: there is always a duty of care for insurers and a legal framework within which decisions must be made. An independent assessment often proves necessary to arrive at a fair solution.
