Insurance fraud occurs more often than many people think. Sometimes deliberately, sometimes accidentally. That is why insurers take strict action. A suspicion hits you hard: claims are stopped, policies can end, and registration looms. At Arslan Advocaten, we help both people who are wrongly suspected and victims of fraud committed by others.
What is insurance fraud?
Insurance fraud occurs when someone deliberately misleads an insurer to obtain a payout. Examples:
- deliberately causing damage;
- exaggerating the extent of damage;
- filing a false report, for example regarding theft or burglary;
- submitting forged invoices;
- concealing important information when taking out the policy.
This ranges from a minor inaccuracy to organized fraud. Even "slightly exaggerating" can already count as fraud.
Civil or criminal law: what is the difference?
In less serious cases, the insurer keeps it civil: rejecting the claim, terminating policies, and recovering costs. In cases involving high amounts or repeat offences, the insurer can also take criminal law steps and file a police report. This can result in a criminal record.
The consequences of (suspected) fraud
- EVR registration: inclusion in the External Reference Register of the CIS Foundation. Other insurers can see this and often refuse new policies. See also Removing EVR registration.
- Termination of policies: multiple current insurance policies can be terminated simultaneously. Sometimes this is not simply permitted; legal review is necessary.
- Recovery and costs: paid amounts and investigation costs (often through SODA) are recovered.
- Legal proceedings: civil and sometimes criminal proceedings.
When is an EVR registration permitted?
Registration is not allowed "on a hunch." There must be sufficient, concrete evidence of deliberate deception at the time of registration. A vague suspicion is insufficient. Additionally, the institution must weigh the interests: your interest against the interest of the sector.
How long does an EVR registration last?
The maximum duration is eight years. This is not automatic. The duration must be proportionate to the case. In lighter cases, a shorter period may suffice. In cases of wrongful registration, removal is possible.
Partial inaccuracy: all or nothing?
If there is an incorrect element in your claim, insurers often reject the entire claim. However, exceptions exist. If you have multiple policies or separate damage items, a partial payout may sometimes be appropriate. This depends on the facts and the terms.
When do insurers file a police report?
Not every suspicion leads to a police report. In cases involving significant amounts, document forgery, repeat offences, or organized fraud, a police report is likely. In other cases, internal measures such as rejection and registration suffice.
Who can see an EVR registration?
All participating insurers can view the EVR. In practice, often only a "high-risk" insurer remains willing to insure you, with higher premiums and limitations. Even within one insurance group, labels share information in internal registers.
Investigation costs (SODA) and other costs
In cases of fraud, insurers routinely charge investigation costs (often through SODA). If they engage external experts, costs increase further. These items are added on top of the rejection or recovery.
Report to CBV or consequences for employment
A report to the Centre for Combating Insurance Crime (CBV) can affect your position in the sector for an extended period. If you work in the financial sector yourself, a report to the regulator may follow in specific cases.
Suspected of fraud: what do you do NOW? (step-by-step plan)
- Request the file. Request all documents on which the suspicion or decision is based.
- Read the reasoning. Are the facts correct? Is the reason stated in the terms?
- Respond carefully. Only provide correct and complete information. No assumptions.
- Collect evidence. Invoices, photos, statements, log files.
- Have your position assessed. We assess lawfulness, proportionality, and registration risk.
- File an objection or submit a complaint. If you cannot resolve it, go to KiFiD or start proceedings.
Victim of insurance fraud by someone else?
You can also be a victim yourself, for example in cases of staged theft or wrongful liability claims. We recover your damages and ensure you do not bear the consequences of someone else's behavior.
