Who is liable for the accident?
The general traffic rules determine the liable party. If the opposing party performed a special manoeuvre (merging, exiting, entering or leaving driveways), they must give priority to all other traffic. In most cases, the opposing party is then liable for the accident. Also in the case of frequent rear-end collisions, the opposing party is generally liable. The opposing party must maintain sufficient distance to be able to bring the vehicle to a stop in time.Who is liable for the accident abroad and how is this regulated?
In general, the law of the country where the accident occurred applies, unless both vehicles are registered with a Dutch licence plate under the Hague Convention on the Law Applicable to Traffic Accidents. However, there are also a number of exceptions included in the Hague Convention on Traffic Accidents:- a) when only a single vehicle is involved in the accident and this vehicle is registered in a State other than the one in whose territory the accident occurred, the internal law of the State of registration is applicable to liability,
- b) when two or more vehicles are involved in the accident, the provisions under a) shall only apply if all vehicles are registered in the same State.
